ZONING VOLUNTARY PROFFERS
I, Chris Moore- president , Santillane LLC , the OWNER of the subject property, located at
1420 Botetourt Road, (P.O. Box 461 , Fincastle, Virginia, 24090
And referenced by Tax Parcel(s): 73(2)13
Do hereby voluntarily submit the following PROFFERS associated with my Zoning Ordinance Amendment
Application: For Heritage Family Market rezoning from A-1 Agriculture to B-2 Business:
- The lot along Frontier (tax parcel id 73D (1)1) will remain A-1.
- If a building permit is not issued for the start of construction on the new Heritage Market within 2 (two) years of the approval of rezoning for this lot (tax parcel id 73(2(13), then it shall revert to A-1 zoning.
- Parcel 73(2)13 shall be developed as a grocery and general/specialty item sales use, in substantial conformity with the preliminary concept plan created by Engineering Concepts, dated January 9, 2024, specifically including:
- meeting the requirements established in the Town’s Enhancement Corridor Overlay District;
- A size limit of 14,500 square feet, consistent with the requirement for a special exception for the smaller lot size for B-2 zoning;
- Two entrances to the property – one from Frontier Way and another from Route 220 -- to minimize the impact of additional traffic within the residential Santillane subdivision;
- A pedestrian walkway to provide access to the Santillane subdivision;
- Appropriate landscape buffering from the surrounding A-1 zoned properties;
- The business will close no later than 9:30 pm each night to minimize impact on the surrounding residential uses;
- The property will not be used as a gas station.
